MiCare Privacy Policy

This MiCare Privacy Policy sets out the practices which MiCare ("we", "us", or "our") has adopted in relation to the collection, storage and usage of your information:

  1. when you browse, use, participate in any activity or service on the MiCare website (“Site”) or post any notice on the Site;
  2. when you respond to other online surveys, polls and purchase;
  3. when you participate in any of the activities organised by MiCare either online or offline; and
  4. when you use our MyMed application.

By using, participating, and browsing any of the above (collectively referred to as “Activities”), you agree that we may gather information about you and your access to or your participation in the Activities and that we may use this information in accordance with this MiCare Privacy Policy.

Personal Information We Collect

Your personal information may be supplied by you or collected from you as a result of your access to or use of or your participation in the Activities. The information we collect from you may include, but is not limited to, the following: name, identification supporting document including identification card number or passport number, marital status, citizenship, photo(s), date of birth or age, gender, height, weight, blood sugar level, blood pressure, contact information, location (GPS) information, physical activity and performance information, intended health goals, COVID-19 vaccination records, as well as system / log information from your electronic device or other third party applications installed on your electronic device.

Other than personal data obtained from you, we may also obtain your personal data from third parties we deal with or are connected with you (for example, insurance companies or your employer), and from such other sources where you have given your consent for the disclosure of personal data and sensitive information relating to you, and/or where otherwise lawfully permitted.

If you are under the age of 18, we do not knowingly seek or collect personal information from or about children without the consent of a parent or a guardian. If we become aware that such personal information that has been submitted to us relates to a child without the consent of a parent or guardian, we will use reasonable efforts to:

  1. Delete the same from its files as soon as possible.
  2. Ensure, where deletion is not possible, that such personal information is not used further for any purpose, nor disclosed further to any third party.

Our Use of Your Information

MiCare respects the privacy of your personal information. Any personal information supplied by you or collected from you as a result of your access to or your participation in the Activities will be used for the following purposes:

  1. to verify your identity;
  2. to enable you to access or participate in the Activities;
  3. to contact you or to send you notifications for alerts you set up for the Activities;
  4. to identify you when you access or participate in the Activities in order for you to enjoy a customised and personalised experience;
  5. to update and enhance our records and to advise you of other products or services which may be of interest to you;
  6. to improve the design and marketing of products and services for your use;
  7. to provide our services to you;
  8. for security and fraud prevention purposes;
  9. for the purposes of statistical analysis of data;
  10. to keep track of your vaccination progress and records; and
  11. responding to your queries.

If you decide that you do not want us to use your personal information or to share your personal information with third parties, you should stop accessing or participating in the Activities, and notify our Data Privacy Officer (see section further below) to remove your personal information.

For information that could not be used to identify you, we may use such information for research and analysis; to display and identify trends within the Application; for marketing and promotional purposes; or to sell it to interested parties.

Disclosure to Third Parties

Your personal information will not be disclosed by us to any third party, unless we have your permission or if it’s at your request or we are under a legal obligation or duty to do so, except for disclosure to the following individuals or entities which you agree to:

  1. other companies in the MiCare group of companies;
  2. government authorities or regulators;
  3. our professional advisers, including without limitation our lawyers, accountants and auditors;
  4. third party service providers (including those who provide payment, administrative or other services to us in connection with running of the Activities and/or of our business) or data processors;
  5. any agent acting on our behalf;
  6. our business alliance partners;
  7. Third parties in connection with our sale, purchase, merger, reorganization, liquidation or dissolution or under similar circumstances
In the event certain Activities provide the ability for you to obtain the services of third parties, you understand and acknowledge that any such third-party services are not part of the Activities nor are such services provided by us. We provide links to these Activities or services but we do not imply any endorsement of the activities or content of the related websites or mobile applications, nor any association with their operators.

This MiCare Privacy Policy does not apply to any such third-party services. As such we strongly recommend that you read and understand their privacy and security policies before using them or providing personal information.

Security

Your personal information is stored on secure servers. We wish to assure you that your personal information will be treated with high standards of security. We maintain reasonable safeguards to protect the confidentiality, security and integrity of your personal information. We use security measures to help protect your personal information against unauthorized disclosure, misuse, or alteration but no data transmission over the Internet can be guaranteed to be 100% secure. We should not be held responsible for events arising from third parties gaining unauthorized access to your personal information if we have taken all reasonable steps to keep your information secure.

Data Retention

We will retain your personal information for as long as your account associated with any of the Activities is still maintained for your access to or your participation in the Activities. We will continue to retain your personal information to the extent such retention is necessary for us to comply with our legal obligations, or to resolve disputes, and/or enforce our agreements with you.

Your request will be processed and routed to your relevant healthcare insurer or company whom is responsible and able to authorize the processing of any personal information.

There is no charge for requesting access to your personal information, but we may require you to meet our reasonable costs in providing you with access (such as photocopying costs or costs for time spent on collating large amounts of material).

Do note that we will only withhold your access to your personal information in extremely limited circumstances, such as:

  1. where it might be dangerous if you were to have it;
  2. where it might prejudice an investigation currently underway;
  3. where it relates to court proceedings and may be subject to the discovery process;
  4. where it may relate to a commercially sensitive decision-making process; or
  5. where other individuals’ personal information is contained in the same record.

This MiCare Privacy Policy is not intended to, nor does it, create any contractual rights whatsoever or any other legal rights, nor does it create any obligations on us in respect of any other party or on behalf of any party.

Changes to the MiCare Privacy Policy

We reserve the right in our sole and absolute discretion to modify without prior warning or notice this MiCare Privacy Policy. You agree that your continued access to or your participation in the Activities after such modification shall constitute an affirmative acknowledgement by you of the modifications and agreement by you to abide and be bound by such modifications.

Inconsistencies

In the event that there shall be any conflict or inconsistencies between the English and Bahasa Malaysia versions of this MiCare Privacy Policy, for the purposes of interpretation and construction, the English language version of this MiCare Privacy Policy shall prevail and be given effect to.
